A bail bond is money that someone pays to the court in exchange for the release of a criminal suspect. In addition to securing the suspect's freedom, the bond helps ensure that they honor all court dates and obligations and stays out of legal trouble until the criminal charges are resolved. If they do, the cost of the bond is returned to the paying individual. Below are a few common types of bonds.

What Are the Different Types of Bail Bonds?

1. Standard

A standard bond requires a payment of 10% of the total bail amount as a deposit. After the resolution of the case, the court returns 90% of that amount to the person that paid it after subtracting any court costs, fees, or fines. A suspect who fails to show up to court at the appointed times will forfeit their 10% deposit and the court will issue an arrest warrant. If the court dismisses the criminal charges or finds the subject not guilty, the entirety of the deposit is refunded.

2. Surety

A surety bond is for individuals who cannot access the needed cash to post bail. They are only available through a bail bondsman, who charges a fee that is usually equal to 10% of the total bail amount. The bondsman submits an insurance policy to the court that promises the entire bail amount if the suspect doesn't appear in court. If you or a loved cannot afford the required 10%, many bondsmen offer payment plans or other flexible options to help you manage the expense. However, after the case, the bail bondsmen keeps the 10% payment, and you do not receive it back.

3. Cash

With a cash bond, you pay the full bail amount to the court as assurance that you'll attend all court dates. Once you honor this commitment and the case ends, the court returns the cash to you after subtracting any fees or fines. All courts accept cash bonds; some may also accept credit cards or cashier's checks. Certain serious criminal charges, in which the suspect is a flight risk, may stipulate that only cash bonds are permissible.
